NATIONAL NEWS<\/u><\/strong><\/p>\n

Extension of Public Health Emergency<\/u><\/strong><\/p>\n

The Public Health Emergency has been extended for another 90 days<\/strong> and is now set to expire on\u00a0 January 21, 2021<\/strong>. Extending the emergency declaration allows providers to continue to use waivers and flexibilities issued to assist in responding to the COVID-19 pandemic. Home Health and Hospice Waivers continue to be in effect until the end of the Public Health Emergency unless otherwise stated in the waiver.<\/p>\n

 <\/p>\n

CMS Announces New Repayment Terms for Medicare Loans (Accelerated and Advance Payment )Made to Providers During COVID-19<\/u><\/strong><\/h1>\n

CMS announced amended terms for payments issued under the Accelerated and Advance Payment (AAP) Program. This Medicare loan program allows CMS to make advance payments to providers, which are typically used in emergency situations. Providers were required to make payments starting in August of this year,\u00a0 but under the Continuing Appropriations Act, 2021 and Other Extensions Act, repayment will now begin one year from the issuance date of each provider or supplier\u2019s accelerated or advance payment<\/strong>.<\/p>\n

After that first year, Medicare will automatically recoup 25% of Medicare payments otherwise owed to the provider or supplier for 11 months. At the end of the 11-month period, recoupment will increase to 50% for another 6 months. If the provider or supplier is unable to repay the total amount of the AAP during this time period (a total of 29 months), CMS will issue letters requiring repayment of any outstanding balance, subject to an interest rate of 4%.<\/p>\n

For providers and suppliers who are experiencing financial hardships, it would be possible to request an Extended Repayment Schedule (ERS)<\/strong>. An ERS is a debt installment payment plan that allows a provider or supplier to pay debts over the course of 3 years, or, up to 5 years in the case of extreme hardship. Providers and suppliers are encouraged to contact their MAC for information on how to request an ERS.<\/p>\n

To allow even more flexibility in paying back the loans, the $175 billion issued in Provider Relief funds can be used towards repayment of these Medicare loans.<\/p>\n

CMS will be communicating with each provider and supplier in the coming weeks as to the repayment terms and amounts owed as applicable for any accelerated or advance payment issued.<\/p>\n

Provider Revalidation<\/u><\/strong><\/p>\n

As provider revalidation is on its way, please note that the deadlines for the next\u00a0revalidation cycle will be in October 2020, based on previous enrollment approval dates. Providers will be contacted via email approximately 6 months prior to their revalidation deadline with further instructions. To check your revalidation due date, please go to https:\/\/www.colorado.gov\/hcpf\/revalidation<\/a> and look for Provider Revalidation Dates Spreadsheet (it was last updated on 10\/12\/20)<\/p>\n

Question of the Week<\/u><\/strong><\/p>\n

Last week we responded to the question \u201c If an Assisted Living Facility requires ALF staff to be tested for COVID on a weekly basis, can the ALF also require \u00a0for home health agency to follow the same standards for the home health staff to be able to continue seeing patients in the ALF?\u201d and determined that ALFs can require Home Health staff to follow the same procedures as ALF.<\/p>\n

This week we had a follow up question:<\/p>\n

Q: Is ALF required to provide COVID-19 testing for home health staff attending patients in ALF residence?\u00a0 <\/strong><\/p>\n

A: The ALF is not required to provide testing for contracted home care providers.\u00a0 The home care agency can set up their own free testing program through the state lab.\u00a0The information on the state lab can be accessed at\u00a0 https:\/\/www.colorado.gov\/pacific\/cdphe\/lab<\/a>.\u00a0 Testing\u00a0 can also be arranged through a private lab at a cost.<\/p>\n
