As the vaccine mandates accommodated various states in three different waives, the Centers for Medicare &amp; Medicaid Services (CMS), Quality, Safety &amp; Oversight (QSO) Group has issued three separate guidance memorandums (QSO-22-07, QSO-22-09, and QSO-22-11) to address compliance with the CMS Omnibus COVID-19 Health Care Staff Vaccination, Interim Final Rule.<br \/>\n<img 30-day, 60-day and 90-day compliance and enforcement time frames from the date that the individual memos were issued, however, the memos include different compliance dates for states, depending on which memo applies.The <strong>first<\/strong> memo <a href=\"https:\/\/amityhealthcaregroup.us20.list-manage.com\/track\/click?u=4db975c828d050c5d07860b6b&amp;id=2979f8656c&amp;e=e99772d279\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=sr&amp;q=https:\/\/amityhealthcaregroup.us20.list-manage.com\/track\/click?u%3D4db975c828d050c5d07860b6b%26id%3D2979f8656c%26e%3De99772d279&amp;source=gmail&amp;ust=1643645627353000&amp;usg=AOvVaw3fsm2KNLgObIEV-wAgBKYp\">(QSO-22-07)<\/a> issued on December 28, 2021, applies to all states except:<\/p>\n<p>Alabama, Alaska, Arizona, Arkansas, Georgia, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Texas, Utah, West Virginia, and Wyoming.<\/p>\n<p>The key compliance dates for the effected states are:<\/p>\n<ul>\n<li>30-day compliance and enforcement -January 27, 2022.<\/li>\n<li>60-day compliance and enforcement \u2013 February 28, 2022<\/li>\n<li>90-day enforcement date is March 28, 2022<\/li>\n<\/ul>\n<p>Federal, state, Accreditation Organization, and CMS-contracted surveyors will begin surveying for compliance with these requirements as part of initial certification, standard recertification or reaccreditation, and complaint surveys 30 days following the issuance of this memorandum (January 27, 2022).<\/p>\n<p>The <strong>second<\/strong> memo <a href=\"https:\/\/amityhealthcaregroup.us20.list-manage.com\/track\/click?u=4db975c828d050c5d07860b6b&amp;id=7b6f6f5977&amp;e=e99772d279\" target=\"_blank\" rel=\"noopener noreferrer\" \u2013 March 15, 2022<\/li>\n<li>90-day enforcement date is April 14, 2022<\/li>\n<\/ul>\n<p>Federal, state, Accreditation Organization, and CMS-contracted surveyors will begin surveying for compliance with these requirements as part of initial certification, standard recertification or reaccreditation, and complaint surveys 30 days following the issuance of this memorandum (February 14, 2022).<\/p>\n<p>The <strong>third<\/strong> memo <a href=\"https:\/\/amityhealthcaregroup.us20.list-manage.com\/track\/click?u=4db975c828d050c5d07860b6b&amp;id=8e579c760b&amp;e=e99772d279\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=sr&amp;q=https:\/\/amityhealthcaregroup.us20.list-manage.com\/track\/click?u%3D4db975c828d050c5d07860b6b%26id%3D8e579c760b%26e%3De99772d279&amp;source=gmail&amp;ust=1643645627353000&amp;usg=AOvVaw2xHm6P_4Eaiiw5AvEU7CL8\">(QSO-22-11)<\/a> issued on January 20, 2022, applies to the state of <strong>Texas<\/strong>.<\/p>\n<ul>\n<li>30-day compliance and enforcement -February 22, 2022.<\/li>\n<li>60-day compliance and enforcement \u2013 March 21, 2022<\/li>\n<li>90-day enforcement date is April 20, 2022<\/li>\n<\/ul>\n<p>Federal, state, Accreditation Organization, and CMS-contracted surveyors will begin surveying for compliance with these requirements as part of initial certification, standard recertification or reaccreditation, and complaint surveys 30 days following the issuance of this memorandum (February 22, 2022).<\/p>\n<p>To confirm the compliance and enforcement dates for each state, CMS has developed a table with state-by-state implementation deadlines for the health care staff vaccination rule. It appears that the providers experienced several claims processing problems associated with NOA. \u00a0According to the National Association for Home Care and Hospice, some of the issues were caused by the Centers for Medicare Know the rules (of photography) before you break them! the headline State Reverses Course, Puts Moratorium on CNA PAR Denials and Reductions last week. \u00a0Please note that the Department of Health Care Policy &amp; Financing has recently met with Health First Colorado (Colorado\u2019s Medicaid program) members and families, providers, and other stakeholders about concerns related to the certified nursing assistant (CNA) pediatric long-term home health (LTHH) benefit prior authorization request (PAR) process. Based on these conversations, the Department has made the decision to temporarily pause the CNA pediatric LTHH PAR process effective November 1, 2021, until June 1, 2022, at the earliest.<\/p>\n<p>Please note that only the PARs related to the CNA pediatric LTHH benefit will be paused. Pediatric LTHH Skilled Nursing Visits, Physical Therapy, Occupational Therapy, Speech Language Pathology, and Private Duty Nursing (PDN) services will continue to require a PAR. Benefits will be reinstated back to November 1, 2021, for Health First Colorado members whose PARs were denied during this time, so there is no gap in services or payment for services.<\/p>\n<p>We are
