The regulations, known as \u201cinformation blocking\u201d rules, were required as part of 2016\u2019s 21st Century Cures Act, and are intended to prevent activity by providers, health IT developers, and health information networks (HINs) &amp; health information exchanges (HIEs) that \u201cis likely to interfere with access, exchange, or use of electronic health information (EHI)\u201d.<\/span><br \/>\n<\/span><span class=\"m_-5387708676529962581mcnCaptionRightContentOuter\"><span class=\"m_-5387708676529962581mcnCaptionRightImageContentContainer\"><br \/>\n<img decoding=\"async\" class=\"m_-5387708676529962581mcnImage CToWUd a6T\" tabindex=\"0\" src=\"https:\/\/ci3.googleusercontent.com\/proxy\/nHjdEtsenW-XoYxIMMkKDofgY-pXlJDhcOhUjtld3_Q8WWrndUjOVKKGomSpEGN9KP-v1YZDTw_nMrGaSLsdwAY2VHX_0KRJ5Qe4JoB2Iv6JCphjmAA5pAj7tvKkv5o3YnAS6WLU568oIx8aqHkpDC3o4d_DCw=s0-d-e1-ft#https:\/\/mcusercontent.com\/4db975c828d050c5d07860b6b\/images\/b5f7752c-cb0f-0200-4eef-fff7ea1283ef.jpg\" alt=\"\" width=\"264\" data-bit=\"iit\" \/><br \/>\n<\/span><\/span><span class=\"m_-5387708676529962581mcnCaptionRightContentOuter\"><span class=\"m_-5387708676529962581mcnCaptionRightTextContentContainer\"><br \/>\n<span class=\"m_-5387708676529962581mcnTextContent\">Examples of information blocking include requiring a patient to provide consent before sharing the patient\u2019s EHI with other providers for treatment or care coordination (if such consent is not required by law) or taking an extended period of time to respond to an EHI request when the provider has the capability to provide access to the EHI on the same day it is requested.<br \/>\n<img decoding=\"async\" class=\"CToWUd\" src=\"https:\/\/ci3.googleusercontent.com\/proxy\/wdFLAKwvRn_Zxek291EhVlHv27LTVONiJFIVNg6xzaTYU5NRFbmh0AX6BOkwicVapmdkAPhhlPlHNOgtc7FqbvxzjAfdTAydfnpRDT1YbJdQRtSeR_gzoDJMGXb5AlOaYfxZdfH-b1kpd1_pN6CeUAsEh665YA=s0-d-e1-ft#https:\/\/mcusercontent.com\/4db975c828d050c5d07860b6b\/images\/0d90364f-d028-175f-3e19-78e1744d5aac.png\" width=\"500\" height=\"5\" data-bit=\"iit\" \/><\/span><\/span><\/span><span class=\"m_-5387708676529962581mcnTextContentContainer\"><br \/>\n<span class=\"m_-5387708676529962581mcnTextContent\">Involved providers that are subject to the \u00a0\u201cinformation blocking\u201d rules are currently required to adhere by them, however, enforcement of the rules and associated penalties have yet to be implemented in practice. <strong>Enforcement process will depend on the future rulemaking that will address information blocking \u201cdisincentives\u201d for providers<\/strong>.<\/span><\/span><\/p>\n<p>Providers are encouraged to familiarize themselves with the requirements of the \u201cinformation blocking\u201d rules and to inquire from their EHR vendor about the current technical capabilities related to providing EHI access.
