In today\u2019s OASIS-E Corner, we will discuss the second component of this item which is determining whether the indication of use was noted for all medications in the high-risk drug class.<br \/>\n<\/span><\/span><\/span><span class=\"m_3266857341469808152mcnTextContentContainer\"><br \/>\n<span class=\"m_3266857341469808152mcnTextContent\">Documentation of indication of use has been a significant challenge for clinicians since the implementation of OASIS-E. It is important to ask the following questions:<\/span><\/span><\/p>\n<ul>\n<li>Do we have the documentation from the provider?<\/li>\n<li>Why is the patient taking this high-risk medication?<\/li>\n<\/ul>\n<p>Why is it important for us to know why the patient is taking the high-risk medication?<\/p>\n<ul>\n<li>It is important for clinicians to know because every patient should have an individualized plan of care.<\/li>\n<li>The patient may not know why they are taking the high-risk medication, and if the medical record does not contain documentation of indication of use for the high-risk medication, the patient faces an increased risk of adverse events, ER visits, and hospital readmissions.<\/li>\n<\/ul>\n<p>If the indication of use for high-risk medications is not documented in the medical records, the best practice would be for the clinician to contact the provider to gather this information and incorporate it into the individualized plan of care including any relevant teaching necessary for the patient and monitoring for any adverse events related to the medication.<br \/>\n<span class=\"m_3266857341469808152mcnTextContentContainer\"><br \/>\n<strong><span class=\"m_3266857341469808152mcnTextContent\"><u>NATIONAL NEWS<\/u><\/span><\/strong><\/span><\/p>\n<p><strong>CMS Ends COVID-19 Vaccination Requirements<\/strong><span class=\"m_3266857341469808152mcnCaptionLeftContentOuter\"><span class=\"m_3266857341469808152mcnCaptionLeftImageContentContainer\"><br \/>\n<img decoding=\"async\" class=\"m_3266857341469808152mcnImage CToWUd a6T\" tabindex=\"0\" src=\"https:\/\/ci4.googleusercontent.com\/proxy\/7SRE2KJM4eSDAMgUA0hEwTH1o-JjtoKljsGa_LZkPt4d07tdXOdGn9PZnrNDvZUVsWXiiiJQS7xjA1MpFTrxYLStpak7jGv-BLQ1SFQNhr0SfKiCIMJ9Gyt5bebPxMmf7GOjpJ9zw_83G6AZLKks9PZFJPy_Qw=s0-d-e1-ft#https:\/\/mcusercontent.com\/4db975c828d050c5d07860b6b\/images\/7871e6b2-949b-8232-752d-5c88b4020895.jpg\" alt=\"CMS Ends COVID-19 Vaccination Requirements\" width=\"264\" data-bit=\"iit\" \/><\/span><\/span><span class=\"m_3266857341469808152mcnCaptionLeftContentOuter\"><span class=\"m_3266857341469808152mcnCaptionLeftTextContentContainer\"><br \/>\n<span class=\"m_3266857341469808152mcnTextContent\">In our last newsletter, we discussed CMS final <a href=\"https:\/\/amityhealthcaregroup.us20.list-manage.com\/track\/click?u=4db975c828d050c5d07860b6b&amp;id=32c18d6e46&amp;e=e99772d279\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/amityhealthcaregroup.us20.list-manage.com\/track\/click?u%3D4db975c828d050c5d07860b6b%26id%3D32c18d6e46%26e%3De99772d279&amp;source=gmail&amp;ust=1689716424231000&amp;usg=AOvVaw0rCJFQiu5a7XT-zbdz38du\">rule<\/a> ending the COVID-19 vaccination requirements for health care providers.<br \/>\n<img decoding=\"async\" class=\"CToWUd\" src=\"https:\/\/ci5.googleusercontent.com\/proxy\/ATt8f9a0Xb_o0xT_xWvNiaJTkoJVFT6QKwm1VnNmUAfMDjXeDLimP5jUMRQCtPGuFpSegIau4YkrgBEu7VNXoPi9ASJYHKiyl2HeTUcBKvz_-KEUWXrTEbxgqaDNVmvRygkRnNmMrRaczLdsIPBfR6c5moGkcA=s0-d-e1-ft#https:\/\/mcusercontent.com\/4db975c828d050c5d07860b6b\/images\/fb51e352-e2f8-afd4-68d8-adea6ff52b75.png\" width=\"500\" height=\"2\" data-bit=\"iit\" \/><br \/>\nThe final rule was set to be published in the Federal Register on <strong>June 5, 2023<\/strong>, and was expected to become <strong>effective 60 days after it was posted to the register (August 4, 2023).<\/strong> Continued compliance with the COVID-19 vaccination rule \u00a0was also expected to be assessed until the time the final rule becomes effective to end the requirement.<\/span><br \/>\n<\/span><\/span><span class=\"m_3266857341469808152mcnTextContentContainer\"><br \/>\n<span class=\"m_3266857341469808152mcnTextContent\">Since, June 5, 2023, additional clarification of the \u00a0rule was received as related to <strong>enforcement of staff vaccination provisions.<\/strong> According to the Federal Register published on June 5, 2023,<em> \u201cFederal rules generally become effective 60 days after publication; however, the COVID-19 PHE expired on May 11, 2023. Our decision to terminate the omnibus facility staff vaccination requirements in this final rule reflect our determination that the emergency circumstances which occasioned these vaccination provisions no longer exist. Since facilities are no longer operating under PHE circumstances, and considering the lower policy priority of enforcement within the remaining time, <strong>we will not be enforcing the staff vaccination provisions<\/strong> between now \u00a0and the effective date, which is 60 days after the date of the publication in the Federal Register\u201d<\/em><\/span><\/span><\/p>\n<p>This means that starting on 6\/05\/23, surveyors will no longer assess compliance with these requirements for any providers. However, providers \u00a0still need to be aware of and comply with any state\/local requirements that may still be in effect, as well as ensure compliance with their own agency policies.<\/p>\n<p><img decoding=\"async\" class=\"m_3266857341469808152mcnImage CToWUd\" src=\"https:\/\/ci5.googleusercontent.com\/proxy\/bPBAuUeqB_bwd5ZMzWpkvcZuNztgd3slQsOhwB1OTy6S5EQrZ0w7IJpm7qrXCDmsULUHKrHIC4N86U4jPDHusV1FhAhfJs29gSIYXIoB5ldJ_xBi0YlxeojlqV1Nb3lZLDqzpkLoJohc9DDHFJHgiHTTeSDo7g=s0-d-e1-ft#https:\/\/mcusercontent.com\/4db975c828d050c5d07860b6b\/images\/ca20fabb-a032-d2b2-ae42-505c4bd83f6a.png\" alt=\"\" width=\"264\" data-bit=\"iit\" \/><span class=\"m_3266857341469808152mcnCaptionLeftTextContentContainer\"><br \/>\n<span class=\"m_3266857341469808152mcnTextContent\"><strong>CMS Guidance on Unannounced Surveys<\/strong><br \/>\n<img decoding=\"async\" class=\"CToWUd\" src=\"https:\/\/ci5.googleusercontent.com\/proxy\/ATt8f9a0Xb_o0xT_xWvNiaJTkoJVFT6QKwm1VnNmUAfMDjXeDLimP5jUMRQCtPGuFpSegIau4YkrgBEu7VNXoPi9ASJYHKiyl2HeTUcBKvz_-KEUWXrTEbxgqaDNVmvRygkRnNmMrRaczLdsIPBfR6c5moGkcA=s0-d-e1-ft#https:\/\/mcusercontent.com\/4db975c828d050c5d07860b6b\/images\/fb51e352-e2f8-afd4-68d8-adea6ff52b75.png\" width=\"500\" height=\"2\" data-bit=\"iit\" \/><br \/>\nOn June 19, 2023, Accreditation Organizations (AOs) received notice from CMS regarding guidance on unannounced surveys, blackout dates, and complaint process as follows:<\/span><br \/>\n<\/span><span class=\"m_3266857341469808152mcnTextContentContainer\"><br \/>\n<span class=\"m_3266857341469808152mcnTextContent\">\u201cIn accordance with both \u00a7488.5(a)(4)(i), which requires unannounced surveys, as well as our long-standing instructions in Chapter 2 of the State Operations Manual (SOM), Section 2700A, we are reiterating that all surveys of providers and suppliers (other than clinical laboratories) must be <strong>unannounced<\/strong>. No contact should occur with the facility prior to the surveyor or survey team\u2019s entrance into the facility.\u201d<\/span><\/span><\/p>\n<p>\u201cAny prior notice of a survey, via email, electronic portals, phone calls, or other means of communication, is considered a violation of CMS regulations.\u201d<\/p>\n<p>\u201cCMS is aware that some AOs allow facilities to request \u201cblackout dates,\u201d which are dates the facility requests or prefers not to be surveyed. Allowing facilities to request dates when they wish not to be surveyed is not consistent with CMS\u2019 survey expectations.\u201d<\/p>\n<p>\u201cAdministrative reviews or offsite complaint investigations and contacting facilities in advance of a complaint survey are inconsistent with CMS\u2019s survey processes for SAs and, therefore, not comparable with or equivalent to CMS as required at \u00a7488.5(a)(4)(ii).\u201d<\/p>\n<p>The changes to AOs processes must \u00a0be implemented by <strong>July 14<\/strong>.<br \/>\n<span class=\"m_3266857341469808152mcnTextContentContainer\"><br \/>\n<strong><span class=\"m_3266857341469808152mcnTextContent\"><u>Preserving Access to Home Health Act of 2023<\/u><\/span><\/strong><\/span><span class=\"m_3266857341469808152mcnCaptionRightContentOuter\"><span class=\"m_3266857341469808152mcnCaptionRightImageContentContainer\"><br \/>\n<a title=\"Interim Infection Prevention and Control Recommendations for Healthcare Personnel During the Coronavirus Disease 2019 (COVID-19) Pandemic\" href=\"https:\/\/amityhealthcaregroup.us20.list-manage.com\/track\/click?u=4db975c828d050c5d07860b6b&amp;id=b42e7c5148&amp;e=e99772d279\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/amityhealthcaregroup.us20.list-manage.com\/track\/click?u%3D4db975c828d050c5d07860b6b%26id%3Db42e7c5148%26e%3De99772d279&amp;source=gmail&amp;ust=1689716424232000&amp;usg=AOvVaw3zEL4sm8JQNnkRdu7rWteW\"> <img decoding=\"async\" class=\"m_3266857341469808152mcnImage CToWUd\" src=\"https:\/\/ci3.googleusercontent.com\/proxy\/EawozSbQhiml2E9e3kPw1zUUw7zDa-B18NtLy6mbFRtQDckWXd34XgDgSI-6NHIqn2DLK8FqvjXdlYwXX49XBOB2POnmM_789c018bE6vvXzCTmz_zyDMyAae5naWBSPXGET5xv13Ro4zu-3OA4tO8lyraqpGw=s0-d-e1-ft#https:\/\/mcusercontent.com\/4db975c828d050c5d07860b6b\/images\/60d2265a-84e3-677b-9600-327952c02daa.png\" alt=\"\" width=\"264\" data-bit=\"iit\" \/> <\/a><br \/>\n<\/span><span class=\"m_3266857341469808152mcnCaptionRightTextContentContainer\"><span class=\"m_3266857341469808152mcnTextContent\">Senators Debbie Stabenow (D-MI) and Susan Collins (R-ME) introduced a bipartisan <em><strong>Preserving Access to Home Health Act of 2023<\/strong><\/em> bill on June 22. The bill would repeal the requirement that the Centers for Medicare and Medicaid Services (CMS) make determinations related to the impact of behavior changes on estimated aggregate expenditures and would eliminate CMS\u2019s authority to adjust home health payments based on such determinations under Patient-Driven Groupings Model (PDGM).<br \/>\n<\/span><\/span><\/span><span class=\"m_3266857341469808152mcnTextContentContainer\"><br \/>\n<span class=\"m_3266857341469808152mcnTextContent\">According to the National Association for Home Care and Hospice (NAHC), the bill will \u201csafeguard access to essential home-based, clinically advanced healthcare services by preventing the Centers for Medicare &amp; Medicaid Services (CMS) from implementing dire cuts of negative 7.85% to the Medicare Home Health Program, which translates to more than $18 billion over the next decade.\u201d Specifically, the bill is designed to address deep cuts made to home health by CMS during the implementation of the Medicare home health payment system \u2013 Patient Driven Groupings Model or PDGM \u2013 by making the following policy changes:<\/span><\/span><\/p>\n<ol>\n<li><strong>Repeals permanent and temporary payment adjustments.<\/strong> The bill would repeal the requirement that CMS make determinations related to the impact of behavior changes on estimated aggregate expenditures and would eliminate CMS\u2019s authority to adjust home health payments based on such determinations under PDGM. This change would take effect and be implemented as if it was included in the Bipartisan Budget Act of 2018 that included home health provisions leading to PDGM implementation.<\/li>\n<li><strong>Instructs MedPAC to analyze the Medicare Home Health Program.<\/strong> The bill instructs MedPAC to review and report on aggregate trends under Medicare Advantage, Medicaid, and other payers, and consider the impact of all payers on access to care for Medicare home health beneficiaries. To verify MedPAC\u2019s calculations, the Commission would be required to make its calculations public. No other training program types may utilize this policy for their graduates. At no time may a graduate of an independently owned, community college, or high school program work while unlicensed. The Board policy is based on the federal regulations allowing those who work and take training within the facility that is approved to offer nurse aide training. Those who qualify under the policy may work for 120 days while they wait to take the exam. If they fail any portion of the exam during that 120 days the policy expires and they cannot work as a CNA until they have passed both portions of the exam and received their CNA from the state.
