\nPart I: OASIS-E item C1310-Signs and Symptoms of Delirium
\n<\/strong>
\nQuestion: How should item C1310 be coded when a patient is comatose at baseline and at the time of assessment?<\/strong><\/em><\/span><\/span><\/span><\/p>\n

Answer:<\/strong> If the patent was comatose at baseline and at the time of assessment, code as follows:
\nC1310A<\/u> – Acute Onset of Mental Status Changes as Code 0 \u2013 No
\nC1310B<\/u> – Inattention as Code 1 – Behavior continuously present, does not fluctuate.
\nC1310C<\/u> – Disorganized Thinking as Code 0 – Behavior not present.
\nC1310D<\/u> – Altered level of consciousness as Code 1 – Behavior continuously present, does not fluctuate.<\/span><\/span><\/p>\n

C1310 identifies any signs or symptoms of acute mental status changes as compared to the patient\u2019s baseline status and if there are any signs or symptoms of delirium present at the time of assessment.<\/p>\n

Part II: OASIS-E Social Determinants of Health Items<\/strong><\/p>\n

CMS has developed a 4-minute, animated explainer video, Social Determinants of Health Items: Determining When a Proxy Response is Allowed<\/strong> for home health providers. This video was developed to assist providers in accurately determining when the use of a proxy response is allowed for Social Determinants of Health items: A1005. Ethnicity, A1010. Race, A1110. Language, A1250. Transportation, B1300. Health Literacy, and D0700. Social Isolation.<\/p>\n

\nOSHA Finalizes Injury and Illness Log Submission Requirements<\/strong><\/span>
\n<\/span>

\nThe Occupational Safety and Health Administration (OSHA) issued a final rule<\/a> that amends its occupational injury and illness recordkeeping regulation to require certain employers to electronically submit<\/strong> injury and illness information to OSHA that employers are already required to keep under the recordkeeping regulation.
\n<\/span><\/span><\/span>
\nOSHA has developed a list (Appendix A) of Industries that will be required to continue to electronically submit Form 300A annually if they have 20 or more employees. OSHA also developed the second, new, list (Appendix B)that includes the industries that OSHA requires submission of Forms 300, 301, and 300A annually if they have 100 or more employees.<\/span><\/span><\/p>\n

Please note that home health agencies are not on the lists<\/strong> and therefore are not included<\/strong> in the OSHA form submission requirements for organizations with less than 250 employees<\/strong>. However, because OSHA finalized \u00a0the requirements for all employers\/entities with 250 or more employees<\/strong> to electronically submit Form 300A-Summary of Work-Related Injuries<\/strong> and Illnesses on an annual basis<\/strong>, large home health organizations will be required to comply with this requirement.<\/p>\n

The above is done with the intent to post the data from the annual electronic submission requirement on a public website after identifying and removing information that reasonably identifies individuals directly.<\/p>\n

This final rule becomes effective on January 1, 2024.<\/strong><\/p>\n

\nNew Edition of Form I-9<\/strong><\/u>
\n
\nOn August 1, 2023, U.S. Citizenship and Immigration Services (USCIS) published a revised version of Form I-9, Employment Eligibility Verification (PDF, 477.5 KB)<\/a>. Among the improvements to the form is a checkbox employers enrolled in E-Verify<\/strong> can use to indicate they remotely examined identity and employment authorization documents under an alternative procedure authorized by the Department of Homeland Security (DHS) described below.<\/span><\/span><\/p>\n

Please note that only<\/strong> employers enrolled in E-Verify<\/strong> have the option to remotely examine their employees\u2019 identity and employment authorization documents under a DHS-authorized alternative procedure. The employers will still be required to examine the documents, retain copies of all documents, conduct a live video interaction with the employee, and create an E-Verify case if the employee is a new hire.<\/span><\/p>\n

Employers who were participating in E-Verify and created a case for employees whose documents were examined during COVID-19 flexibilities (March 20, 2020 to July 31, 2023), may choose to use the new alternative procedure starting on August 1, 2023<\/strong> to satisfy the physical document examination requirement by August 30, 2023<\/strong>.<\/p>\n

Employers who were not enrolled in E-Verify during the COVID-19 flexibilities must complete an in-person physical examination by August 30, 2023.<\/strong><\/p>\n

The revised Form I-9<\/strong> (edition date 08\/01\/23) will have an expiration date of 07\/31\/2026. Employers can use the current Form I-9 (edition date 10\/21\/19) through October 31, 2023. Starting November 1, 2023, all employers must use the new Form I-9.<\/strong><\/p>\n
