Medicaid Services (CMS) has issued revisions to the <strong>Medicare State Operations Manual<\/strong>, <a href=\"https:\/\/amityhealthcaregroup.us20.list-manage.com\/track\/click?u=4db975c828d050c5d07860b6b&amp;id=496f43e281&amp;e=e99772d279\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/amityhealthcaregroup.us20.list-manage.com\/track\/click?u%3D4db975c828d050c5d07860b6b%26id%3D496f43e281%26e%3De99772d279&amp;source=gmail&amp;ust=1712176064474000&amp;usg=AOvVaw0KEkMYGr4a5FND8zkSySka\">Appendix B<\/a>, also referred to as the <em>Interpretive Guidelines for the home health Conditions of Participation(CoPs)<\/em>.<br \/>\n<img decoding=\"async\" class=\"CToWUd\" src=\"https:\/\/ci3.googleusercontent.com\/meips\/ADKq_NZqEJsdE-I_lYUENQ-lVEw-SBTd_uTIe9cY4LbuvPQRMS8pp4Y6cYopeeIFhyftqdeGSYRwSLvwn2w7NlRBnD6AYv2ao69IYMhPp2xD18zSp5JHjkFGecx2EUyMmT-MlOdbzq4N9OckhmY5kHf4aNitUPXVF7kFWE0=s0-d-e1-ft#https:\/\/mcusercontent.com\/4db975c828d050c5d07860b6b\/images\/fb51e352-e2f8-afd4-68d8-adea6ff52b75.png\" data-bit=\"iit\" \/><\/span><\/span><\/span><span class=\"m_-2417409605430571792mcnTextContentContainer\"><br \/>\n<span class=\"m_-2417409605430571792mcnTextContent\">According to CMS memorandum, in the revised Appendix B CMS:<\/span><\/span><\/h4>\n<ul>\n<li>Revises the Level 1 standards that surveyors must assess during a standard survey.<\/li>\n<li>Adds three Emergency Preparedness tags to Level 1 standards. (A partial extended survey is conducted when noncompliance is identified in any Level 1 Standard).<\/li>\n<li>Adds a cross-reference to Appendix Z for the HHA emergency preparedness tags.<\/li>\n<li>No longer identifies specific Level 2 standards; instead, when noncompliance with a Level 1 standard is identified, all remaining standards within the relevant CoP are evaluated, and a determination will be made as to the compliance with the condition.<\/li>\n<li>Revises tags to reflect updated regulatory language based on final rules and adds interpretive guidance where appropriate.<\/li>\n<li>Consolidates tags to remove redundancy.<\/li>\n<li>Adds survey procedures to multiple tags to assist surveyors in assessing compliance with the regulatory requirements.<\/li>\n<li>Makes multiple technical and formatting revisions to fix regulatory citations, acronyms, and tag titles.<\/li>\n<li>Retires CMS memos that are no longer applicable or have been incorporated into Appendix B.<\/li>\n<li>Adds the survey protocol for HHAs to Part I of Appendix B. Appendix B replaces older CMS memos that we are retiring and describes the requirements and procedures for conducting an HHA survey.<\/li>\n<\/ul>\n<p>Below, you will find several examples of the revisions:<\/p>\n<p><strong>\u00a7484.55(c) Standard: Content of the comprehensive assessment.<\/strong><\/p>\n<p>(c)(5) A review of all medications the patient is currently using \u2026 CMS has modified the guidance to no longer require the RN review the medication list in therapy cases, and states:<\/p>\n<ul>\n<li><em>\u201cEach agency must determine the capabilities of current staff members to perform comprehensive assessments, considering professional standards or practice acts specific to the State. No specific discipline is identified as exclusively able to perform the medication review. However, only Registered Nurses (RNs), Physical Therapists (PTs), Occupational Therapists (OTs) and Speech-Language Pathologists (SLPs) are qualified to perform comprehensive assessments (see also \u00a7484.55(b)). While only the assessing clinician is responsible for accurately completing and signing a comprehensive assessment, the agency may develop a policy where clinicians may collaborate to collect data for all OASIS items. For example, to assess potential side effects and drug interactions, the agency may wish to have RNs or practical (vocational) nurses, as defined in \u00a7484.115, review the mediation lists.\u201d<\/em><\/li>\n<\/ul>\n<p><strong>\u00a7484.60(a)(2) The individualized plan of care must include the following: (i) All pertinent diagnoses.<\/strong><\/p>\n<p>CMS revises the definition for pertinent diagnoses to not require all known diagnoses,<\/p>\n<ul>\n<li><em>\u201cIn general, pertinent diagnoses include, but are not limited to, the chief reason the patient is receiving home care and the diagnosis most related to the current home health plan of care. Additionally, comorbid conditions that exist at the time of the assessment, that are actively addressed in the patient\u2019s Plan of Care, or that have the potential to affect the patient\u2019s responsiveness to treatment and rehabilitative prognosis should be considered and documented.\u201d<\/em><\/li>\n<\/ul>\n<p><strong>\u00a7484.80(g)(1) Standard: Home health aide assignments and duties. \u00a0<\/strong><\/p>\n<p>CMS clarifies that when both nursing and therapy services are involved, either skilled professional may assign home health aides and develop written patient care instructions.<\/p>\n<p><strong>\u00a7484.105(b)(1) Standard: Administrator. The administrator must: (i) Be appointed by and report to the governing body.<\/strong><\/p>\n<p>CMS removed the definition for \u201creports to\u201d that prohibited the administrator from using intermediaries when reporting to the governing board.<\/p>\n<p>Please review a revised <a href=\"https:\/\/amityhealthcaregroup.us20.list-manage.com\/track\/click?u=4db975c828d050c5d07860b6b&amp;id=22690f4242&amp;e=e99772d279\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/amityhealthcaregroup.us20.list-manage.com\/track\/click?u%3D4db975c828d050c5d07860b6b%26id%3D22690f4242%26e%3De99772d279&amp;source=gmail&amp;ust=1712176064474000&amp;usg=AOvVaw2xTVyI8PIVN4-ck5MqfXmZ\">APPENDIX B<\/a>. Please note that NAHC and Accrediting Organizations (AOs) are reviewing changes to the Appendix B and will continue to inform providers of any corresponding changes to AOs standards and\/or survey protocols. NAHC is also working on developing a crosswalk between the current version and the revised version of the Appendix B in addition to other educational offerings.<\/p>\n<p><strong><u>OIG Issues Annual Medicaid Fraud Control Unit Report<\/u><\/strong><\/p>\n<p><span class=\"m_-2417409605430571792mcnCaptionRightContentOuter\"><span class=\"m_-2417409605430571792mcnCaptionRightImageContentContainer\"><br \/>\n<img decoding=\"async\" class=\"m_-2417409605430571792mcnImage CToWUd a6T\" tabindex=\"0\" src=\"https:\/\/ci3.googleusercontent.com\/meips\/ADKq_NaQkYRyk4ypuS01PAIQ6Mjtxv1HZrhpVkngQNdQT7J24q-9MhpjB5_7HbeCquOF3IQrMFcvwnGjymcQSgjYT2c8En9BLO-tNmRCfSJZog_u_OHnRJR3kVBJ2NlS3pJO0DlgpzsifEo5V0TqwLygrLNdo28w9MCIxoM=s0-d-e1-ft#https:\/\/mcusercontent.com\/4db975c828d050c5d07860b6b\/images\/8aa1e20e-1de3-1c5a-14f7-99e333995a50.jpg\" alt=\"\" width=\"264\" data-bit=\"iit\" \/><br \/>\n<\/span><\/span><span class=\"m_-2417409605430571792mcnCaptionRightContentOuter\"><span class=\"m_-2417409605430571792mcnCaptionRightTextContentContainer\"><br \/>\n<span class=\"m_-2417409605430571792mcnTextContent\">On Thursday, March 14th, the Office of Inspector General (OIG) at the Department of Health and Human Services released a report detailing the 2023 outcomes from the State Medicaid Fraud Control Units across the country. The report identifies several areas of interest for home health and personal care providers and demonstrates the OIG\u2019s focus on compliance in health care industry.<br \/>\n<img decoding=\"async\" class=\"CToWUd\" src=\"https:\/\/ci3.googleusercontent.com\/meips\/ADKq_NZqEJsdE-I_lYUENQ-lVEw-SBTd_uTIe9cY4LbuvPQRMS8pp4Y6cYopeeIFhyftqdeGSYRwSLvwn2w7NlRBnD6AYv2ao69IYMhPp2xD18zSp5JHjkFGecx2EUyMmT-MlOdbzq4N9OckhmY5kHf4aNitUPXVF7kFWE0=s0-d-e1-ft#https:\/\/mcusercontent.com\/4db975c828d050c5d07860b6b\/images\/fb51e352-e2f8-afd4-68d8-adea6ff52b75.png\" data-bit=\"iit\" \/><br \/>\nSpecifically, the OIG report discussed:<\/span><\/span><\/span><\/p>\n<ul>\n<li>Criminal convictions for incidents of abuse or neglect<\/li>\n<li>Criminal convictions for fraud<\/li>\n<li>Ongoing open investigations for fraud<\/li>\n<\/ul>\n<p>The full report is available <a title=\"Medicaid Fraud Control Units Fiscal Year 2023 Annual Report\" href=\"https:\/\/amityhealthcaregroup.us20.list-manage.com\/track\/click?u=4db975c828d050c5d07860b6b&amp;id=242e1ef231&amp;e=e99772d279\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/amityhealthcaregroup.us20.list-manage.com\/track\/click?u%3D4db975c828d050c5d07860b6b%26id%3D242e1ef231%26e%3De99772d279&amp;source=gmail&amp;ust=1712176064474000&amp;usg=AOvVaw38ejBA-ljlhtSfsDuZUVMj\">HERE<\/a>.<\/p>\n<p><strong><u>Updated COVID-19 Isolation Guidelines<\/u><\/strong><\/p>\n<p><span class=\"m_-2417409605430571792mcnTextContentContainer\"><span class=\"m_-2417409605430571792mcnTextContent\">On March 1, 2024, the Centers for Disease Control and Prevention (CDC) announced update to its COVID-19 guidance and is no longer recommending that individuals who test positive for COVID-19 isolate for five days. \u00a0Instead, CDC is now offering a \u201cunified approach\u201d to management of respiratory viruses that include flu and RSV along with COVID-19.<\/span><br \/>\n<\/span><span class=\"m_-2417409605430571792mcnCaptionRightContentOuter\"><span class=\"m_-2417409605430571792mcnCaptionRightImageContentContainer\"><img decoding=\"async\" class=\"m_-2417409605430571792mcnImage CToWUd a6T\" tabindex=\"0\" src=\"https:\/\/ci3.googleusercontent.com\/meips\/ADKq_NbJUDfqWLs8uN5qXDP9gOOIjcnIuYCSCsN5__m1uSfD7qXVtx5PhsPHqYCm8p55JYttDo_Y3M2NU51hPcKopYGoMpfDepypOdHrAKij6RgNcACP-P5mEWF4Yoc1U4dkDkqhc0SAFOapg8vPnW_5AzZSi3cjAKV--WY=s0-d-e1-ft#https:\/\/mcusercontent.com\/4db975c828d050c5d07860b6b\/images\/a12a1815-e9ef-ae07-d9f8-f76a796ce412.jpg\" alt=\"\" width=\"264\" data-bit=\"iit\" \/><br \/>\n<\/span><\/span><span class=\"m_-2417409605430571792mcnCaptionRightContentOuter\"><span class=\"m_-2417409605430571792mcnCaptionRightTextContentContainer\"><br \/>\n<span class=\"m_-2417409605430571792mcnTextContent\">In the light of the revised guidelines, individuals who develop various respiratory virus symptoms, including fever, chills, fatigue, cough, runny nose, and headache should monitor themselves and are recommended to <strong>\u201cstay home and away from others&#8221;<\/strong>, but also advised that they can return to normal activities if their symptoms are improving and they have not had a fever without the use of fever-reducing medication for at <strong>least 24 hours<\/strong>. A stay has a maximum length of 60 days and cannot be extended. However, CMS can impose a stay of less than 60 days. It is not required that each assigned stay period be 60 days.<\/p>\n<p>Claims submitted by the provider with dates of service within the stay period will be rejected.
