uses an interpreter to provide the responses for the OASIS item A1250 -Transportation, does this mean the patient is unable to respond, and both Code X &#8211; Patient unable to respond and the information obtained from the interpreter should be coded?<\/p>\n<p><strong>Answer:<\/strong> When a patient responds in their preferred language with the use of an interpreter, this is considered a patient response. You would not code X &#8211; Patient unable to respond. Patients may respond to questions in English, or in their preferred language with the assistance of an interpreter.<\/p>\n<\/div>\n<div>\n<h2><\/h2>\n<h2 class=\"m_4554562373301627983default-heading2\"><strong>NATIONAL NEWS<\/strong><\/h2>\n<\/div>\n<div>\n<h3 class=\"m_4554562373301627983default-heading3\"><strong>CMS Home Health Final Rule<\/strong><\/h3>\n<\/div>\n<p><span class=\"m_4554562373301627983r8-o\" role=\"presentation\"><span class=\"m_4554562373301627983r19-i\"><span role=\"presentation\"><span class=\"m_4554562373301627983r5-c\"><span class=\"m_4554562373301627983r6-o\" role=\"presentation\"><span class=\"m_4554562373301627983r13-i\"><span role=\"presentation\"><span class=\"m_4554562373301627983r27-c\"><a href=\"https:\/\/ds72c.r.ag.d.sendibm3.com\/mk\/cl\/f\/sh\/SMK1E8tHeG7ufsRImi0gjRdoCwg3\/IwNExyTGG-_f\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=https:\/\/ds72c.r.ag.d.sendibm3.com\/mk\/cl\/f\/sh\/SMK1E8tHeG7ufsRImi0gjRdoCwg3\/IwNExyTGG-_f&amp;source=gmail&amp;ust=1732138082008000&amp;usg=AOvVaw2zv3cLay6naFHh5oX_j7l-\"><img decoding=\"async\" title=\"National Alliance for Care at Home\" src=\"https:\/\/ci3.googleusercontent.com\/meips\/ADKq_NZtA2TA2VuHkQyS01czyAqAuB-O5DpS-ZathfBawMUJDydafyZ1YHqhiMq0obZyruxI1QuMcR9nOvOS7WFvh6FswcaHjWxmBalj3XDPdZ-u_x3-L_ePgWOtBMoER6IsAV82uOyk_-9es9rfHlOJ4DYD4A=s0-d-e1-ft#https:\/\/ds72c.img.ag.d.sendibm3.com\/im\/sh\/HLTYVafBfJ3u.jpg?u=7xwQLFBtniwQnLwUOULJ3RDFdClc3JH\" width=\"254\" border=\"0\" \/><\/a><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p>As you know, on November 1, 2024, the Centers for Medicare and Medicaid Services (CMS) issued Home Health <a title=\"FY 2025 Final Rule\" href=\"https:\/\/ds72c.r.ag.d.sendibm3.com\/mk\/cl\/f\/sh\/SMK1E8tHeGEm81GFxsAApGwYBFGJ\/l-ePd-uenE7j\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=https:\/\/ds72c.r.ag.d.sendibm3.com\/mk\/cl\/f\/sh\/SMK1E8tHeGEm81GFxsAApGwYBFGJ\/l-ePd-uenE7j&amp;source=gmail&amp;ust=1732138082008000&amp;usg=AOvVaw3jlauVkZvjCDFyR53Yyxyi\">CY 2025 Final Rule<\/a>.<\/p>\n<p>As always, the Final Rule addressed multiple areas impacting home health industry ranging from rate cuts, PDGM, and Conditions of Participation to quality reporting and OASIS data collection.<\/p>\n<div>\n<p>Below, you will find a summary of the final rule for your review.<\/p>\n<p>&nbsp;<\/p>\n<p><strong><u>Home Health Conditions of Participation<\/u><\/strong><\/p>\n<p>CMS finalized a <strong>new standard at \u00a7 484.105(d)<\/strong> that will require Home Health Agencies (HHAs) to develop, implement, and maintain an acceptance-to-service policy that is applied consistently to each prospective patient referred for home health care.<\/p>\n<p>The policy is expected to, at a minimum, address the following criteria related to the HHA\u2019s capacity to provide patient care:<\/p>\n<ul>\n<li>The anticipated needs of the referred prospective patient<\/li>\n<li>The HHA\u2019s case load and case mix<\/li>\n<li>The HHA\u2019s staffing levels, and the skills and competencies of the HHA staff<\/li>\n<\/ul>\n<p>The HHAs will also be required to <strong>make available to the public<\/strong> accurate information regarding the services offered by the HHA and any limitations related to types of specialty services, service duration, or service frequency.<\/p>\n<p>The HHAs will be required to review the information included in the policy as frequently as the services change but no less often than <strong>annually<\/strong>.<\/p>\n<p><i>Please note that the final rule does not prevent HHAs from maintaining their existing acceptance-to-service policies; rather, it is intended to complement them.<\/i><\/p>\n<p><strong><u>Financial Implications<\/u><\/strong><\/p>\n<p>The Final Rule includes the following:<\/p>\n<ul>\n<li>A net <strong>2.7% inflation update<\/strong> (3.2%% Market Basket Index \u2014 0.5% Productivity Adjustment)<\/li>\n<li>A <strong>base PDGM 30-day payment rate of $2057.35 for 2025<\/strong> (compared to the 2024 base rate of $2,038.15)<\/li>\n<li>A <strong>1.975%<\/strong> Budget Neutrality <strong>permanent adjustment (- 1.975%)<\/strong><\/li>\n<li><strong>Recalibration<\/strong> of the <strong>432 case mix weights<\/strong> that leads to a separate budget neutrality adjustment in the payment rates of <strong>1.0039%<\/strong>.<\/li>\n<li>Modification of <strong>wage index weights and wage index area designations<\/strong> leading to a budget neutrality adjustment of <strong>0.9988%<\/strong>.<\/li>\n<\/ul>\n<p><strong>Overall, CMS estimates that Medicare payments to HHAs in CY25 would increase in the aggregate by 0.5%.<\/strong><\/p>\n<p><strong><u>Home Health Quality Reporting Program (HHQRP)<\/u><\/strong><\/p>\n<p><strong>New Assessment Items \u2013 Social Determinants of Health (SDoH)<\/strong><\/p>\n<p>CMS finalized its proposal for HHAs to collect four (4) new items as standardized patient assessment data elements under the SDOH category using the Outcome and Assessment Information Set (OASIS):<\/p>\n<ul>\n<li>One item for living situation<\/li>\n<li>Two items for food<\/li>\n<li>One item for utilities<\/li>\n<li>CMS also proposed to modify the transportation item<\/li>\n<\/ul>\n<p><strong>HHAs will be required to report these new assessment items beginning with patients admitted on January 1, 2027, for purposes of the CY 2027 HH QRP program year.<\/strong><\/p>\n<p><strong><u>OASIS Data Collection<\/u><\/strong><\/p>\n<p>OASIS data collection will be required for patients with all payer sources on or after <strong>January 1, 2025, for the phase-in (voluntary) period<\/strong> or on or after <strong>July 1, 2025, for the mandatory period.<\/strong><\/p>\n<p><strong>All-payer data collection<\/strong> is to begin with the <strong>Start of Care (SOC) OASIS data collection timepoint<\/strong>. The SOC is the first assessment that can be submitted for a non-Medicare\/non-Medicaid patient, either on or after January 1, 2025, for the phase-in (voluntary) period or on or after July 1, 2025, for the mandatory period, as noted above.<\/p>\n<p><strong><u>Other updates:<\/u><\/strong><\/p>\n<p><strong>Payment amount for disposable negative pressure wound therapy (dNPWT) device for CY 2025<\/strong><\/p>\n<p>CMS finalized the separate payment amount for a dNPWT device. The final CY 2025 separate payment amount for a dNPWT device will be $276.57 (compared to CY 2024 payment amount of $270.09).<\/p>\n<p><strong>Provider and supplier enrollment requirements<\/strong><\/p>\n<p>CMS is adding providers and suppliers that are reactivating their Medicare billing privileges to the categories of new providers and suppliers subject to a provisional period of enhanced oversight (PPEO). CMS may impose a PPEO for 30 days to one year for new providers and suppliers. The goal of a PPEO is to reduce and prevent fraud, waste, and abuse. During a PPEO, CMS may, among other things, conduct prepayment medical review and cap payments. CMS can apply a PPEO to new providers or suppliers, which are defined as providers or suppliers that are: (1) newly enrolling; (2) undergoing a change of ownership under 42 CFR \u00a7 489.18; and\/or (3) undergoing a 100% change of ownership via a change of information.<\/p>\n<\/div>\n<div>\n<h3><\/h3>\n<h3 class=\"m_4554562373301627983default-heading3\"><strong>Are You Compliant With Non-Discrimination Notice?<\/strong><\/h3>\n<p><span class=\"m_4554562373301627983r27-c\"><a href=\"https:\/\/ds72c.r.ag.d.sendibm3.com\/mk\/cl\/f\/sh\/SMK1E8tHeGLdaA5D92Jev6FI9XqZ\/UMFJcHULN8pv\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=https:\/\/ds72c.r.ag.d.sendibm3.com\/mk\/cl\/f\/sh\/SMK1E8tHeGLdaA5D92Jev6FI9XqZ\/UMFJcHULN8pv&amp;source=gmail&amp;ust=1732138082008000&amp;usg=AOvVaw2JDvhzEB6bTarbyMBLknfK\"> <img decoding=\"async\" title=\"Medicare Revalidation\" src=\"https:\/\/ci3.googleusercontent.com\/meips\/ADKq_NZRri0H50uccAXgjjnol1czPLah-vcwQPGqNeyQ2zD5WXHugG7VEYhE6V9tvkN7-gO1op97xP3ZUN06YawyCPws106QOm6bRv-UNqhR6TqJToLYpazJZLgGhCWdjCUricWCf51py1vsiIEI3TVn3O-QKg=s0-d-e1-ft#https:\/\/ds72c.img.ag.d.sendibm3.com\/im\/sh\/NqbFJMdY9uzD.png?u=7xwQLFBtniwQnSnwXJIUDahLSVVaLtX\" width=\"254\" border=\"0\" \/><\/a><\/span><\/p>\n<h3 class=\"m_4554562373301627983default-heading3\"><span class=\"m_4554562373301627983r8-o\" role=\"presentation\"><span class=\"m_4554562373301627983r19-i\"><span role=\"presentation\"><span class=\"m_4554562373301627983r5-c\"><span class=\"m_4554562373301627983r6-o\" role=\"presentation\"><span class=\"m_4554562373301627983r15-i\"><span role=\"presentation\">\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/h3>\n<\/div>\n<div>\n<p>As you may remember, on May 5, 2024, the U.S. Department of Health and Human Services (HHS) issued in the Federal Register a <a title=\"Final Rule\" href=\"https:\/\/ds72c.r.ag.d.sendibm3.com\/mk\/cl\/f\/sh\/SMK1E8tHeGSV2IuAKCT90vY27qQp\/MYFYcGUeL1WR\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=https:\/\/ds72c.r.ag.d.sendibm3.com\/mk\/cl\/f\/sh\/SMK1E8tHeGSV2IuAKCT90vY27qQp\/MYFYcGUeL1WR&amp;source=gmail&amp;ust=1732138082008000&amp;usg=AOvVaw1682mut76nt2kMVry1ilTh\">final<\/a> rule implementing Section 1557 of the <i>Affordable Care Act<\/i> (ACA), which prohibits discrimination on the basis of race, color, national origin, sex, age, and disability in certain health programs and activities.<\/p>\n<\/div>\n<div>\n<p>In addition to a general prohibition on discrimination, on the basis of race, color, national origin, sex, age, and disability, there are several procedural requirements that covered entities, including home health agencies, must implement <i>(please refer to table below)<\/i>.<\/p>\n<\/div>\n<table width=\"100%\">\n<tbody>\n<tr>\n<td><\/td>\n<\/tr>\n<tr>\n<td>\n<table width=\"742\">\n<tbody>\n<tr>\n<td width=\"209\"><strong>Procedure\/ Requirement<\/strong><\/td>\n<td width=\"355\"><strong>Description<\/strong><\/td>\n<td width=\"178\"><strong>Due Date<\/strong><\/td>\n<\/tr>\n<tr>\n<td width=\"209\"><strong>\u00a0<\/strong><\/p>\n<p><strong>1557 Coordinator designation<\/strong><\/td>\n<td width=\"355\">&nbsp;<\/p>\n<p>The rule requires health care providers with\u00a0<strong>15 or more employees<\/strong>\u00a0to designate at least one employee to serve as a\u00a0<strong>Section 1557 Coordinator\u00a0<\/strong>to manage organization\u2019s efforts to comply with and carry out the covered entity\u2019s responsibilities under Section 1557.
